Rox Speed FX, Inc® | Minimum Advertised Price Policy
Section 1 - Introduction
Rox Speed FX has a long history of manufacturing valuable, dependable, Made in the USA products to consumers.
We recognize that our success is tied to the success of our network of select authorized dealers. We also know that many of our dealers invest significant time and resources to deliver an extraordinary customer experience. We want to protect their ability to do so, while at the same time discouraging price-based advertising that would be detrimental to our dealer's service and support efforts. As a result, Rox Speed FX has unilaterally established this Minimum Advertised Price (“MAP”) Policy.
Section 2 - Policy Statement
Rox Speed FX items advertised by a reseller shall not at any time be priced more than 10% below MSRP or it will be considered a violation of this policy. MSRP and the MAP Prices are listed in section 6, (“MAP Products”). Rox Speed FX, in its sole discretion, reserves the right to discontinue doing business with any reseller that advertises any product(s) at a price lower than the MAP.
Section 3 - General Guidelines
The products covered by this policy are listed in Section 6, (“MAP Products”). Rox Speed FX may in its sole discretion modify any part of this policy at any time, including the list of covered products. Section 4 - Advertising Guidelines
The MAP Policy applies to all advertisements of MAP Products in any and all media, including but not limited to flyers, posters, coupons, mailers, inserts, newspapers, magazines, catalogs, television, radio, and public signage, as well as websites, social media sites, apps, or any other electronic media.
Website features such as “click for price”, automated “bounce-back” pricing e-mails, pre-formatted e-mail responses, forms, and automatic price display for any items prior to being placed in a customer’s shopping cart, and other similar features are considered to be communications initiated by the dealer (rather than by the customer) and thereby constitute “advertising” under this MAP Policy.
Section 5 - Policy Enforcement
Rox Speed FX reserves the right to cancel any pending orders, restrict future orders, or suspend dealers' account altogether if Rox Speed FX reasonably believes a dealer has violated any of the provisions in this policy.
Rox Speed FX will monitor the advertised prices of dealers. Dealers are expected to provide reasonable cooperation in any Rox Speed FX investigations regarding possible MAP Policy violations. Hindering, obstructing, delaying, or otherwise failing to cooperate with a Rox Speed FX MAP Policy investigation is also itself a violation of this MAP Policy.
The MAP Policy will be enforced by Rox Speed FX in its sole discretion and without notice. Violations of this policy may result in any of the aforementioned penalties up to and including termination of our business relationship, as well as any available legal remedies.
No salesperson or unauthorized person may modify or grant exceptions to this policy. Any questions regarding this policy should be directed to Mark Dillon, Marketing Director of Rox Speed FX, Inc.
